Terms and Conditions (“Terms”)

Please read these Terms and Conditions carefully before purchasing IELTS Progress Check practice tests (“Progress Check”) from IELTS Australia Pty Ltd (ABN 84 008 664 766), the British Council and Cambridge Assessment English, collectively the “IELTS Co-Owners”. Your access to and use of Progress Check is conditional on your acceptance of and compliance with these Terms. By accessing or using Progress Check you agree to be bound by these Terms.

Practice Test

 

Progress Check is an online practice test intended to assist you in your preparation for your IELTS Test.

After you take Progress Check, you will receive a feedback report on your Practice Test which provides you with:

  • feedback on areas the markers consider you could improve upon in order to achieve your desired level of English language competence; and
  • Progress Check results set out in IELTS indicative band scores.

The feedback report will be available within five days of completing your practice test. You can access the report by logging into your IELTS Progress Check account. You will also receive an email to notify you when your report is ready. This will be sent to the email address you provided at the point of purchase.

Progress Check is similar to but not identical to the IELTS Test. The Practice Test is made available to you online, outside a test location, and is not taken under supervised examination conditions. As an example, the speaking component of Progress Check is delivered through prompted onscreen questions, not face to face with a person as it is in an IELTS Test. Your Practice Test results are indicative of the results you are capable of achieving in the IELTS Test but do not guarantee you the same results in the IELTS Test. Progress Check is not itself a form of testing approved by recognising organisations (such as universities and immigration bodies) as a measure of English language competence.

You acknowledge that Progress Check is jointly owned by the IELTS Co-Owners.

You must take your Progress Check yourself and must not permit others to have access to Progress Check or test items. Progress Check is for personal, non-commercial use only.

From the day of purchasing a practice test, you have 90 days to complete that practice test. After this period, the test will be locked.

Age and Location requirements You can take IELTS Progress Check if you are under 16, but it is not recommended. The test content of both IELTS Progress Check and the IELTS test are designed for adult English language learners.
Intellectual Property

 

You acknowledge that Progress Check is and remains the intellectual property of the IELTS Co-Owners and Progress Check and Feedback report are made available to you only for the purpose of you taking Progress Check. You must not use, copy, reproduce or distribute Progress Check or any element of it or the feedback report other than for the purposes of taking Progress Check and your preparation for your IELTS Testing.
Privacy and Personal Data

 

You acknowledge that personal data provided in relation to booking a Practice Test and receiving a feedback report on the completed test is collected for the purposes of Progress Check and you consent to this data being disclosed to, processed and stored by the IELTS Co-Owners for the purposes of such administration. You understand that your personal data may be processed in an anonymous form for statistical and research purposes by the IELTS Co-Owners and that you may be contacted in relation to IELTS testing. Your use of Progress Check is subject to applicable terms of the IELTS privacy policy which is found at https://www.ielts.org/policy/privacy-policy. Progress Check is an “IELTS Test” for the purposes of the IELTS privacy policy.
Liability and Services Disclaimer

 

Taking Progress Check requires uninterrupted access to the internet, power supply, web sites or services that are not owned or controlled by the IELTS Co-Owners. The IELTS Co-Owners have no control over, and assume no responsibility for such access or services. You further acknowledge and agree that the IELTS Co-Owners shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such access or services.

The IELTS Co-Owners and any other party involved in creating, producing or delivering Progress Check are not liable for any direct, incidental, indirect, consequential special, punitive or similar damages arising out of access to, use of, acceptance by or interpretation of the results by any third party, or any errors or omissions in the contents of Progress Check.

In any event, our maximum liability is limited to, at our election, re-supplying Progress Check or refunding Progress Check fee.

Refund Policy We will refund your Progress Check fee, if you cancel the test prior to Progress Check being made available for download. Other than where required by law, no refunds will be given once you commence downloading Progress Check.
Changes

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We also reserve the right to change, limit or discontinue any aspect, content or feature of Progress Check as well as the site or platform on which Progress Check is made available.

If a revision is material we will try to provide reasonable notice prior to any new terms taking effect. What constitutes a material change and what constitutes reasonable notice will be determined at our sole discretion.

Governing Law These Terms and your access to and use of Progress Check are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the Courts of Victoria, Australia for determining any dispute concerning this agreement or Progress Check.
Access through Apple App Store Progress Check is made available through a number of platforms, including the Apple App Store. If you access Progress Check through the Apple App Store you will be bound by the Licensed Application End User Agreement located at https://www.apple.com/legal/internet-services/itunes/appstore/dev/stdeula/

These Terms shall apply in the event of any inconsistency between the Apple Terms and these Terms.
